1. Acceptance of Terms

By accessing or using Martial OS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Martial OS is a gym and martial arts studio management platform that provides tools for lead management, member tracking, class scheduling, trial bookings, automated workflows, and kiosk check-in. The Service is provided on an "as is" and "as available" basis.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account and keep this information up to date. You agree to notify us immediately of any unauthorized access to or use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Upload or transmit viruses, malware, or any other malicious code
• Use the Service to send unsolicited communications or spam
• Reproduce, duplicate, or resell any part of the Service without express written permission

5. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Martial OS and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any data you input into the Service, but grant us a limited license to use, store, and process that data to provide the Service.

6. Limitation of Liability

To the fullest extent permitted by law, Martial OS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of the Service. In no event shall our total liability exceed the amount you have paid us in the twelve months preceding the claim.

7. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Martial OS operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of that jurisdiction.
